In the name of the blessed Trinity Amen. I Thomas
Lord Leigh Baron of Stoneleigh in the County of Warwick being att
this time by Gods mercy in good and perfect understanding for which
I render unto his devine Majesty all possible praise and thankes
doe this sixth day of January in the yeare of our Lord God One
Thousand six hundred seaventy and One make this my last Will and
Testament in manner and forme following First I give my gracious
God an entire sacrifice both of my body and soule with my most
humble thankes for that assurance which his blessed spirit imprints
in mee of the Resurrection of one and Salvation of both and for
establishing mee in a chearefull and constant resolution to live
and dye a true member of that Protestant Church into which I was
baptized in expectation of a joyfull Resurrection I will that my
body may be buried in the vault I lately erected on the Southside
of the Chancell of Stoneleigh Church in the same private manner
that my deare wife Dame Mary Leigh was lately interred And whereas
by a Deed Tripartite beareing date the Five and Twentith day of
June in the seaventeenth yeare of the Reigne of our late Soveraigne
Lord King Charles the First of ever blessed memory made between
mee the said Thomas Lord Leigh by the name of S[ir] Thomas Leigh
Kn[igh]t and Baronet Dame Mary Leigh my then wife of the first
part S[i]r Thomas Leigh Kn[igh]t by the name of Thomas Leigh Esq[uire]
then my eldest sonne and heire apparent since deceased John Leigh
Esq[uire] younger brother of mee the said Thomas Lord Leigh Christopher
Leigh and Ferdinando Leigh two of the younger sonnes of mee the
said Thomas Lord Leigh of the second part William Turney of Leighton
Bussard in the County of Bedford gent[leman] and Innocent Rash
of Stoneleigh aforesaid gent[leman] on the third part thereof is
a power reserved and given to my Executors to raise after my decease
out of divers Lands in the said Tripartite Deed of Indenture mentioned
the summe of Two Thousand pounds to be paid to such person or persons
as I the said Thomas Lord Leigh by my last Will and Testament or
by any Deed or Deeds or writeing under my hand and seale to be
subscribed and sealed in the presence of two or more credible witnesses
shall limitt and appoint Now I doe hereby nominate Limitt and appoint
bequeath and devise the said Two Thousand pounds to be paid by
my Executor hereafter named to my three Grandaughters Honara Leigh
Mary Leigh and Jane Leigh the daughters of my said sonne S[i]r
Thomas Leigh deceased in manner and forme following vizt. to Honara
Leigh the eldest of my said three Grandaughters the summe of six
hundred sixty six pounds Thirteen shillings and Foure pence And
to the said Mary Leigh her sister the like summe of six hundred
sixty six pounds Thirteen shillings and foure pence And to the
said Jane Leigh her sister alsoe the like summe of six hundred
sixty six pounds Thirteen shillings and Foure pence being the residue
and remainder of the said Two Thousand pounds to be paid them and
every and either of them att theire severall dayes of marriage
provided they doe marry with the consent and good likeing of my
sonne Charles Leigh and in case any or either of my said three
Grandaughters shall happen to depart this naturall life before
they shall be married Then my Will and meaneing is that the Legacy
of any one of them soe dyeing shall goe and be paid to the surviveing
sisters or sister And till they shall be married it is my further
Will that my Executor hereafter named shall pay or cause to be
paid unto them the full and just consideration and interest of
the said Two Thousand pounds for their better provision and maintenance
Alsoe I doe give and devise more to my said Grandaughter Honara
Leigh the sum of six hundred sixty six pounds Thirteen shillings
and Foure pence And to my said Grandaughter Mary Leigh the like
summe of six hundred sixty six pounds Thirteen shillings and Foure
pence And to my said Grandaughter Jane Leigh the like summe of
six hundred sixty six pounds Thirteen shillings and Foure pence
being in the whole the summe of Two Thousand pounds more to be
paid them every or either of them att theire severall dayes of
marriage Provided they marry with the consent and good likeing
of my said sonne Charles Leigh And in case any or either of my
said three Grandaughters shall happen to depart this naturall life
before they shall be married Then my Will and meaneing is that
the Legacy of any one of them soe dyeing shall goe and be paid
to the surviveing sisters and sister And till they shall be marryed
it is my further meaneing And Will That my Executor hereafter named
shall pay or cause to be paid unto them the full and just consideration
and interest of the said Two Thousand pounds more hereby given
or devised unto them for theire better provision and maintenance
which last mentioned Two Thousand pounds my Executor may the more
cheerfully pay by reason that there is due unto mee upon a statute
acknowledged by his late Father the summe of Two Thousand pounds
ever since the death of my Mother in Law Dame Elizabeth Egerton
which now by this my last Will and Testament will devolve upon
him And whereas I have lent my said sonne Charles Leigh Two Thousand
pounds towards the purchaseing Burbery al[ia]s Burdingbury in the
County of Warwick which he secured unto mee out of the said Lands
by Indenture beareing date the seaventeenth day of October in the
Twelfth yeare of the Reigne of his Majesty that now is our soveraigne
Lord King Charles the second Now my Will true intent and meaneing
is that my said sonne Charles shall be freed and discharged of
and from the said Two Thousand pounds which I hereby give and bequeath
unto him And that my Executor hereafter named shall surrender yeild
and give up unto my said sonne Charles as well the said Indenture
beareing date the said seaventeenth day of October One Thousand
six hundred and sixty if it may lawfully come to his hands and
Custody it being att present in the keeping and possession of William
Pryor Francis Winton John Buckner and Richard Doggett or some one
of them as alsoe all the estate and interest of mee in the said
Burbery al[ia]s Burdingbury and other Lands and Tenements in the
said recited Indenture mentioned and expressed or conveyed to mee
as aforesaid when as my said Charles shall pay and fully satisfy
unto the said William Pryor Francis Winton John Buckner and Richard
Doggett and theire Assignes the summe of One Thousand pounds being
the proper debt of my said sonne Charles and unto whom att the
request of my said sonne Charles I have granted all my estate in
Burbery al[ia]s Burdingbury aforesaid for secureing the payment
of the said One Thousand pounds And alsoe fully acquitt and discharge
my Executor hereafter named from the same Item I give bequeath
and devise unto my said sonne Charles all my right property interest
and estate terme of yeares yet to come and unexpired that I have
of in and to the Mannor of Leighton Bussard in the County of Bedford
and all other Mannors Tennements Faires Tolls Courts and
all other things whatsoever specified mentioned expressed and contained
in an Indenture or Lease beareing date the Eighteenth day of February
in the Two and Twentieth yeare of the Reigne of our soveraigne
Lord King Charles the second made between the Deane and Cannons
of the Kings Free Chappell of Windsor on the one part and mee the
said Thomas Lord Leigh on the other part together with the said
Lease and all right of renewing the same Neverthelesse upon this
Condition that my said sonne Charles pay unto my sonne Christopher
Leigh the summe of Fifteen hundred pounds with all interest that
shall be due for the same att the time of my decease according
to a Proviso contained in a Lease beareing date the Eight and Twentieth
day of March in the Two and Twentieth yeare of the Reigne of our
soveraigne Lord King Charles the second and made between mee the
said Thomas Lord Leigh on the one part and the said Christopher
Leigh on the other part granted to him of the said Mannor of Laighton
Bussard Lands matters and other things contained in the Lease beforementioned
granted mee by the Deane and Canons of Windsor to secure him the
payment of the said Fifteene hundred pounds that I borrowed of
him and all interest for the same with a Clause of Redemption Item
I give devise and bequeath unto my Grandsonne and Heire apparent
Thomas Leigh Esq[uire] my sole Executor hereafter appointed all
my right interest property and estate terme of yeares yet to come
and unexpired which I have of and in another Lease of the Mannor
of Studham lyeing and being in the County of Bedford and Hertford
and all Lands Tennements meadowes pastures Leassowes Feedings woods
and underwoods and all other services rents rights profitts services
Commodities emoluments and advantages whatsoever part or parcell
of or reputed to be part of or parcell of or in any wise belonging
to the said Mannor of Studham And alsoe that Capitall Messuage
or Farme in Edisborough and Slapton lyeing and being in the County
of Buck[ingham] granted unto mee by the said Deane and Canons of
Windsor beareing date the Eighteenth day of February in the Twenty
second yeare of the Reigne of our soveraigne Lord King Charles
the second and made between them the said Deane and Canons of Windsor
on the one part and mee the said Thomas Lord Leigh on the other
part with the said Lease To the intent and purpose hereafter mentioned
and to noe other intent or purpose whatsoever That is to say to
the use and behoofe of my said three Grandaughters Honora Leigh
Mary Leigh and Jane Leigh and to the end and purpose that the said
Thomas Leigh shall in some convenient time make sale of the said
Lease of the Mannor of Studham and Edisborough Farme and dispose
the money ariseing thereby equally and proportionably to them and
the survivors and survivor of them in case any of them happen to
dye before the sale thereof Item I give and bequeath unto my daughter
the Lady Tracy One hundred pounds Item I give and bequeath unto
my said sonne Charles Leigh One hundred pounds and alsoe all those
household goods that att the time of my decease I shall have in
my house att Leighton Bussard aforesaid wherein my servant Winton
now inhabites Item I give and bequeath unto my said sonne Christopher
Leigh One hundred pounds Item I give and bequeath unto my daughter
the Lady Isham One hundred pounds Item I give and bequeath unto
my daughter the Lady Bramley One hundred pounds And further I give
and bequeath to the Poore of Stoneleigh parish aforesaid Twenty
pounds To the Poore of Ashoe parish in the said County of Warr[wick]
Five pounds To the Poore of Leek Wotten al[ia]s Church Wotten parish
in the said County of Warr[wick] Five pounds To the Poore of Killingworth
al[ia]s Kenelworth in the said County of Warr[wick] Five pounds
To the Poore of Cubington parish in the said County of Warr[wick]
Five pounds And to the Poore of the parish of the said Laighton
Bussard in the said County of Bedford Tenne pounds to be distributed
by the Churchwardens and Overseers of the Poore of each parish
respectively because I desire a private buriall without concourse
of people which generall distributions doe allwayes occasion Item
I give and bequeath unto every of my servants that shall relate
to mee att the time of my decease onehalfe yeares wages over and
above the next halfe yeares wages that shall become due to such
servants after my decease And for all the rest of my goods and
Chattles and estate whatsoever unbequeathed and not disposed of
I give bequeath and devise them all unto my said Grandsonne and
Heire apparent Thomas Leigh Esq[uire] whom I make ordaine and constitute
my sole Executor of this my last Will and Testament revoakeing
annulling and annihilating all former Wills whatsoever by mee att
any time heretofore made In witnesse whereof I the said Thomas
Lord Leigh have hereunto sett my hand and seale the day and yeare
